ICC Issues Arrest Warrants for Netanyahu, Gallant, and Hamas Commander Over Alleged War Crimes

Judges at the International Criminal Court (ICC) have issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Defence Minister Yoav Gallant, and Hamas military commander Mohammed Deif. The move comes amid allegations of war crimes and crimes against humanity during the recent Israel-Hamas conflict.

In a landmark ruling, the ICC rejected Israel’s objections to its jurisdiction, stating that it has the authority to investigate and prosecute crimes committed in Gaza, the West Bank, and East Jerusalem.

Allegations Against Netanyahu and Gallant

The ICC accuses Netanyahu and Gallant of responsibility for several grave crimes, including:

  • The war crime of using starvation as a method of warfare.
  • Crimes against humanity include murder, persecution, and inhumane acts.
  • Directing intentional attacks against civilian populations.

Netanyahu condemned the decision, calling it “antisemitic” and an attack on Israel’s right to self-defence. Gallant also criticised the ICC, accusing it of equating Israel’s actions with those of Hamas and undermining its fight against terrorism.

Charges Against Mohammed Deif

Hamas commander Mohammed Deif faces charges of orchestrating:

  • Murder, extermination, and torture.
  • Sexual violence and cruel treatment.
  • Hostage-taking and targeting civilians.

Although Israeli authorities claim Deif was killed in an airstrike in July, the ICC noted it could not verify his death and proceeded with the warrant.

Global Reactions

The ICC’s decision has triggered a mixed international response.

  • Support for Enforcement: Italy and the Netherlands publicly intended to arrest the accused if they entered their territories. Other European Union nations have affirmed their commitment to the ICC’s rulings.
  • Rejection by Allies: Israel and the United States have denounced the warrants, with the White House reiterating its opposition to ICC jurisdiction over non-member states. US lawmakers are pushing for sanctions against those assisting in ICC investigations targeting American or allied nationals.

Challenges to Enforcement

While ICC member states must execute arrest warrants, enforcement has been inconsistent. Past cases, such as South Africa’s failure to arrest Sudanese President Omar al-Bashir in 2015 and Mongolia’s recent reception of Russian President Vladimir Putin, demonstrate the complexities of implementing ICC rulings.

Netanyahu’s ability to travel to ICC member states may be limited, though he has recently avoided visiting such countries.

Reactions from Israel and Palestine

Israeli leaders dismissed the ICC’s decision, with Netanyahu describing it as a “dark day for humanity.” Hamas, however, welcomed the warrants against Israeli leaders as a historic step toward justice.

In Gaza, Palestinians expressed cautious optimism. “This decision may ease some of my pain, but true justice will only come when Netanyahu and others are held accountable,” said Munira al-Shami, whose sister was killed in an Israeli airstrike.

An Uncertain Path Forward

The ICC’s actions mark a historic moment in international justice but leave many questions unanswered. Whether these warrants will lead to arrests or greater accountability remains to be seen as the Israel-Palestine conflict continues to cast a long shadow on the global stage.
